Accelerated Rehabilitative Disposition
Most of my clients want to “keep their record clean”. ARD, or an Accelerated Rehabilitative Disposition, affords a person charged with a DUI the opportunity to get an expungement of your criminal record. You also do not face jail time if you are placed into ARD. Finally, you are subject to a reduced license suspension, compared to the penalties for a DUI conviction in Chester County.
To qualify for ARD, there are two basic requirements which DUI offenders must meet: You must have no previous criminal record (in most cases). Next, the DUI charge must be a misdemeanor, meaning you are not charge with vehicular homicide.
There are other requirements that you must also meet:
- You must have had a valid license and insurance at the time of your DUI charge.
- There can be no injuries involved (other than to yourself) in the DUI — for example, you did not get in an accident where a person was injured.
- You must also not be charged with a “hit and run” if there was an accident.
- If you are accepted into ARD for a DUI, there is no jail time.
Process for DUI ardTo apply for ARD, you and your DUI lawyer will first have to waive your Preliminary Hearing at the district court. You will be ordered to get a CRN (“Court Reporting Network”) evaluation, complete Alcohol Highway Safety School, potentially complete some community service, and pay towards your court costs and fines.When you are placed into ARD, you will be under “unsupervised” probation for 6 – 12 months. You will have to stay out of trouble during this time and fulfill all of your ARD obligations. After this occurs, you will the opportunity to get an expungement and keep our record clean.
